Article 0 - Preamble

Article 1: object

These conditions govern the sales (VPC) carried out by JFG Entreprise, 1200 Chemin de Bourdet, 64300 Labeyrie of musical instruments and accessories, called "Jeff" in the document.

In the case of an order to a country other than mainland France, you are the importer of the product (s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums do not come under my jurisdiction.

They will be at your expense and are your sole responsibility, both in terms of declarations and payments to the competent authorities and bodies in your country.

All orders, whatever their origin, are payable in euros.

I reserve the right to modify the prices at any time, but the product will be invoiced on the basis of the tariff in force at the time of the validation of the order and subject to availability.

The products remain my property until full payment of the price.

As soon as you take physical possession of the products ordered, the risk of loss or damage to the products is transferred to you.

Article 4 - Validation of your order

Article 5 - Order and Payment

Confirming your order implies for you

1- Order and Pay online for a product in stock:

Payment for your purchases is made by bank card using

secure Paypal system,

payment possible also by PayPal, by bank transfer or in several installments with Alma.

I send you a confirmation email, I pack, dispatch,

and I inform you of the departure of the package for the Mondial Relay relay point that you have chosen.

2- Order and Payment of a product out of stock:

You fill in one of the site's payment form I send you a payment link or my bank details in case of transfer.

Once payment has been made (funds available)

I start manufacturing (10 working days on a standard cajon)

I do the packing, the shipping,

and I inform you of the departure of the package for the relay point

of Mondial Relay that you have chosen.

3-order and Payment of a particular order

I send you a detailed quote,

-You validate the quote by paying (bank transfer, CB, Paypal or in installments) a deposit of 50% max of the order.

(deposit not recoverable in case of order cancellation).

-I make the instrument within the time specified in the quote,

(usually 10 days for a cajon).

-You pay at choice by bank transfer, CB, several times with Alma, the balance of the order.

- I proceed to the packaging, the dispatch of the order

and I inform you of the departure of the package.


Article 6 - Withdrawal

In accordance with the provisions of article L.121-21 of the Consumer Code, you have a withdrawal period of 14 days from the receipt of your products to exercise your right of withdrawal without having to justify reasons or to pay penalty.

Returns must be made in their original condition and complete (packaging, accessories, instructions). In this context, your responsibility is engaged. Any damage suffered by the product on this occasion may be such as to defeat the right of withdrawal.

Return costs are your responsibility.

If the right of withdrawal is exercised, I will reimburse the amounts paid, within a maximum period of 30 days after the return of your order to the workshop.

And I reimburse you by bank transfer (only, no CB refund).

Exceptions to the right of withdrawal:

In accordance with the provisions of article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to:

  The provision of services (for example a repair) fully executed before the end of the withdrawal period and the execution of which has started after the express prior agreement of the consumer and express waiver of his right of withdrawal.

    The supply of goods made up (personalized or made-to-measure instrument) according to the consumer's specifications or clearly personalized.

Article 7- Availability

My cajons are offered as long as they are visible on the site and within the limits of available stocks (noted next to the name of the model).

For cajons not available (zero in stock), see ordering methods in article 5.

In case of unavailability of product after placing your order, which would be quite exceptional (for example: material damaged by my fault just before I ship it ...), I will inform you by email and by such . Your order will be automatically canceled and any amounts paid will be refunded in full without delay.

In addition, I do not intend to sell my cajons in large quantities, I work by hand so, if you order several instruments (associations, schools, conservatories ...), you will have to accept a sufficiently long manufacturing time to get it right, call me (I can't write it enough).

Article 8 - Delivery

The products are delivered to the delivery address indicated during the ordering process. For direct purchases from stock or online, the deadline is indicated on a validation email in general. Mondial Relay takes 3 to 5 working days to deliver.

For specific projects the manufacturing time is noted on the quote sent to the customer.

In the event of a delay in shipment, an email or telephone call will be sent to you to inform you of a possible consequence on the delivery time which has been indicated to you.

In accordance with legal provisions, in the event of late delivery, you have the possibility of canceling the order under the terms and conditions defined in article L 138-2 of the Consumer Code.

I cannot be held responsible for a delay in delivery due exclusively to the unavailability of the customer who does not pick up his product at the relay point

Article 9 - Guarantee

1- The legal guarantee against hidden defects (articles 1641 to 1649 of the civil code):

"The seller is bound by the warranty for hidden defects in the thing sold which makes it unfit for the use for which it is intended, or which so diminishes this use, that the buyer would not have acquired it, or n 'would have given them a lower price, if he had known them.'

"The professional is not liable for apparent defects of which the purchaser has been able to convince himself, but for hidden defects, even though he would not have known them, unless, in this case, he has not stipulated that he will not be obliged to any guarantee. "

The defect must be prior to the sale and make the products unfit for the use for which they are intended.

The buyer has the choice:

-Return the thing and get the price returned;

- Keep the thing and get part of the price.

-The time to act is 2 years from the discovery of the defect.

-These are the judges of the merits who sovereignly assess whether the thing

sold is unsuitable for its destination.

The “legal against hidden defects” guarantee may in no case be used to cover financial losses linked to a malfunction (concert canceled, studio recording canceled, etc.).

2- All my instruments benefit from a 2 year contractual guarantee.

Cases where the warranty does not apply:

- In the event of improper use.

- This warranty can only apply to the first owner and in so far as the instrument has not undergone repairs or interventions carried out by a third party.

- The warranty does not cover damage not due to violin making or those linked to improper use, conservation and maintenance of the instrument: shocks, exposure to strong variations in temperature and humidity, scratching of the varnish, ... etc.

- The guarantee does not cover damage due to transport (insurance already does) ...

- The warranty does not cover wearing parts (tapa, bottom of the feet ... etc).

The “contractual” guarantee may in no case be used to cover financial losses linked to a malfunction (concert canceled, studio recording canceled, etc.).

Guarantee implementation:

During the warranty period (2 years), in the event of a defect falling within the scope of the warranty, the customer contacts Jeff by telephone and by post to explain his problem.

After verification by Jeff of the handling of this problem under the warranty, the owner sends the instrument (in its original packaging) to JFG Entreprise, 1200 Chemin de Bourdet, 64300 Labeyrie, to proceed with a repair or an exchange.

The processing time once the object is returned to the workshop will depend on the defect.

It may be offered a refund at purchase value less or not the obsolescence or the state of use of the object.

All complaints, requests for warranty repairs, exchange or reimbursement must be made by telephone and by post to JFG Entreprise, 1200 Chemin de Bourdet, 64300 Labeyrie.

The products must be returned in the state in which you received them with all the elements (accessories, original packaging, instructions ...).

The return costs will be depending on the case at your expense or mine, the shipping costs after repair or exchange will be at my expense.

Article 10 - Liability

The products offered comply with current French legislation.

My responsibility cannot be engaged in case of non-compliance with the legislation of the country where the product is delivered.

It is your responsibility to check with local authorities the possibilities of importing or using the products or services that you plan to order.

I cannot be held responsible for damage resulting from improper use of the product purchased.

the maximum weight tolerated by the cajons is 120 kg max on 4 feet, if you exceed this weight, I can gracefully strengthen your cajon, ask for it when placing the order and I will manufacture it by integrating this parameter ...

Nor be held responsible for financial losses linked to a malfunction or a delay in the delivery of an instrument (concert canceled, studio recording, etc.).

Finally, my responsibility cannot be engaged for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, an external intrusion or the presence of computer viruses.

Article 11 - Applicable law in the event of disputes

The language of this contract is French. These conditions of sale are subject to French law. The court of Pau (64, France) will be the only court to contact in the event of a dispute.

Article 12 - Intellectual property

All elements of the site are and remain the intellectual and exclusive property of Jeff.

No one is authorized to reproduce, exploit, redistribute or use for any reason whatsoever, even partially, elements of the site whether software, visual or audio.

Certain technical parts of my instruments are intellectually protected, so I invite you not to copy my work, under penalty of legal proceedings which I will not deprive myself of ...

Payment in installments with Alma.

In case of problem, you contact me, you take a photo of the problem, after finding the defect, I send you a shipping slip at my expense so that you return the cajon, I receive it, I repair it and I re - ship at my expense. if repair is not possible, I can replace your instrument with the same model.

A standard cajon is guaranteed for 2 years, an excellence cajon is guaranteed for life.

The warranty is valid for normal use and excluding wearing parts (tapa).

Do not tamper with the 1/2 drum tones, you risk bending them and it will damage the sound and it will not be taken under warranty.

Like any solid wood musical instrument, this cajon is sensitive to temperature, avoid leaving it in direct sunlight outside or behind glass.
